Definitions
"Service" means the Lucidpic website, apps, APIs, and hosting. "Content" means anything you upload, prompt, or generate. "Output" means AI-generated images or video. "NSFW" means sexual content of any kind. "Minor" means a person under 18. "Consumer" means an individual acting outside their trade, business, craft, or profession. "Business User" means any non-consumer user. "Account Holder" means the registered user of an account.
1. Acceptance of Terms
By accessing or using Lucidpic's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

3. Service Description and Online Safety Act Position
Service Nature: Lucidpic provides AI image and video generation tools and hosting to deliver outputs to the account holder only. We do not run discovery, feeds, public galleries, comments, messaging, or search across user content. Asset delivery uses time-limited signed URLs or authenticated requests. Asset links are unlisted, blocked from indexing, and may be rotated or revoked at any time.

Online Safety Act Position: The Service is designed not to be a user-to-user or search service and does not publish pornography within the meaning of the Online Safety Act 2023. Access to user assets is delivered via time-limited signed links or authenticated requests. If the Service is ever operated in a way that brings it within scope, we will comply with applicable duties (including illegal content safety duties and, if relevant, age-assurance). We may take business-disruption measures (including disabling links, geoblocking, or rate-limiting) to comply with lawful orders.
API Terms: API keys are personal to your account. Keep your keys secret. No reselling, benchmarking, scraping, or publishing competitive performance tests without written consent. We may throttle, revoke, or rotate keys for abuse, security, or legal reasons.
No Public Reporting UI: The Service provides no discovery or public galleries. There is no "report button on public content." Abuse reports are accepted only via the account dashboard and hello@lucidpic.com.
4. Data Roles and Processing
Data Roles: We are a data controller for account data, billing, usage logs, abuse prevention, and product analytics. For enterprise/API processing performed on a customer's documented instructions, we act as a processor; our Data Processing Addendum (DPA) applies and is incorporated by reference.
5. Eligibility and Account Registration
To use our services, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Promptly update your account information if it changes
- Accept all risks of unauthorized access to your account
You are responsible for all activity that occurs under your account. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.
Age Assurance: We reserve the right to use age assurance or age verification technologies to ensure users are 18 years of age or older. You agree to provide accurate information regarding your age and to cooperate with any age verification checks we may implement. Where we use age assurance, we do so to comply with law and our safety measures (UK GDPR Art. 6(1)(c) and/or 6(1)(f)). We retain proofs only as long as needed for verification, then delete or irreversibly hash.
6. User Conduct and Acceptable Use Policy
You must not use the Service to create, upload, host, or share:
- NSFW content of any kind
- Any depiction of minors (real, synthetic, or "young-looking"), including sexualised or suggestive contexts
- Non-consensual intimate imagery, sexualised deepfakes, or misuse of biometric identifiers
- Content that promotes or instructs suicide, self-harm, or eating disorders
- Terrorism, criminal instruction, or other illegal content
- IP-infringing content
- Harassment, doxxing, or threats
- Attempts to bypass safety systems, scrape asset URLs, or attack the Service
- Content in violation of export controls or sanctions
Filters: Safety filters are on by default. Disabling any filter does not permit banned content. We may block generations, re-enable filters, or suspend accounts. Violations may result in immediate termination without refund.

7. Likeness and Publicity Rights
You must have clear consent to use any identifiable person's image or likeness. Some jurisdictions (including parts of the US) recognise right of publicity for public figures; you are responsible for compliance. No celebrity pornographic or sexualised content is permitted under any circumstances.
7a. EU AI Act Compliance
For EU users: Where applicable, we will meet transparency duties for AI-generated content (e.g., labelling/watermarking) and, if we ever qualify as a GPAI provider, the obligations and guidelines published by the European Commission (including technical documentation and copyright safeguards).
8. Fair Usage Policy
To ensure service stability and availability for all users, we reserve the right to limit generation rates or resource usage if we detect excessive or automated use that negatively impacts the platform. This applies to all plans, including "unlimited." We may rate-limit, queue, or throttle excessive use that degrades others' access.
9. Pricing, Payment, and Refunds
Our services are offered through various pricing plans:
- Credit packages for pay-as-you-go usage
- Monthly or annual subscription plans
- Enterprise custom pricing (where applicable)
Payment Terms:
- All prices are in USD unless otherwise specified
- Payment is due immediately upon purchase
- We accept major credit cards and other payment methods as displayed
- Prices are subject to change with 30 days' notice
Subscription Renewals and Cancellation: Unless you cancel before the end of your billing period, your subscription will automatically renew. You can cancel your subscription at any time through your account settings. The cancellation will take effect at the end of the current billing period, and you will not be charged for the next period.
Renewal Reminders & Cancellation: We will send renewal reminders a reasonable time before each renewal and provide a straightforward online cancellation route (no hidden steps). We will clearly disclose any price changes before renewal.
Refund Policy and Consumer Rights:
- Cooling-off (consumers): UK/EU consumers have 14 days to cancel most distance contracts. If you ask us to start supply immediately, you lose this right once supply begins. We will obtain your express consent and acknowledgement at checkout
- Credits: If you have not started using credits, we may refund unused credits within 14 days; used credits are non-refundable. After 14 days, refunds are at our discretion unless required by law
- Subscriptions: You can cancel anytime; access continues until the end of the current period. We do not refund partially used periods unless required by law or a material service failure on our side
- Refund Timelines: We will reimburse valid refunds within 14 days of a valid cancellation under Consumer Contracts Regulations
- VAT: UK consumer prices are shown inclusive of VAT where applicable
- Consumers have statutory remedies under the Consumer Rights Act 2015 for digital content not of satisfactory quality or as described; nothing here excludes those rights

10. Intellectual Property Rights
Your Content:
- You retain ownership of images you generate, subject to these Terms
- You grant us a limited, worldwide, royalty-free license to use, store, and display your content as necessary to provide the services
- License for Custom Model Training: Where you use our service to train a custom AI model (e.g., for personalized avatars), you grant us the right to use the content you upload for the sole purpose of training and providing that specific custom model for your account's use. We will not use this uploaded content to train our general AI models or for any other user's model without your explicit consent
- Model Improvement: We may use prompts, metadata, and Outputs to provide and improve the Service (e.g., safety, quality), subject to our Privacy Policy. If we offer an opt-out in your account, we will honour it except for safety/abuse detection
- You are responsible for ensuring you have rights to any uploaded content
- You warrant you have consent and rights for any identifiable person used in prompts or uploads
- Generated content may be similar to outputs created by other users
Our Property:
- The Lucidpic platform, software, and AI models remain our exclusive property
- Our trademarks, logos, and brand features may not be used without permission
- Feedback you provide may be used by us without compensation
11. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy. By using Lucidpic, you consent to:
- Collection and use of your personal information as described in our Privacy Policy
- Processing of your prompts and outputs for service improvement
- Storage of your generated content on our secure servers
- Use of cookies and similar technologies
We comply with UK GDPR and data protection regulations. You have rights to access, correct, and delete your personal data.

12. Copyright and Defamation Notice & Takedown
We respond to clear notices of alleged copyright, trademark, publicity rights infringement, and defamation. While the UK does not have a formal DMCA process, we maintain a robust notice-and-takedown procedure:
Copyright and IP Notices
- Identify the copyrighted work, trademark, or personality right claimed to be infringed
- Identify the specific content on our service alleged to infringe with URL or clear description
- Provide your contact information (name, address, phone, email)
- Include a statement of good faith belief that the use is not authorized
- Include a statement under penalty of perjury that the information is accurate and you are authorized to act
- Provide your electronic or physical signature
- For personality/publicity rights: Include proof of identity or authorization to act for the person depicted
Defamation Notices
To report allegedly defamatory content hosted by us, email hello@lucidpic.com with "Defamation Notice" in the subject line and include:
- The asset URL or clear location of the content
- The specific words or content complained of
- Explanation of why the content is defamatory
- Your contact details (name, address, email, phone)
- Confirmation that the complaint is not trivial or vexatious
- A statement of truth regarding the accuracy of your complaint
We may disable access expeditiously while we contact the user or assess the claim, consistent with the Defamation Act 2013 s.5 and the Defamation (Operators of Websites) Regulations 2013.
Repeat Infringer Policy: We reserve the right to terminate the accounts of users who are found to be repeat infringers of intellectual property rights. Multiple valid infringement notices may result in permanent account suspension without refund.

13. Third-Party Services and Links
Our services may contain links to third-party websites or services that are not owned or controlled by Lucidpic. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such third-party services.
14. Service Availability and Modifications
We reserve the right to:
- Modify or discontinue any part of the service at any time
- Change features, functionality, or pricing with reasonable notice
- Perform maintenance that may temporarily interrupt service
- Set limits on storage, generation frequency, or other features
We do not guarantee continuous, uninterrupted, or error-free operation of the services.
15. Security and Vulnerability Disclosure
Do not probe, scan, or attack the service. For good-faith security research, contact security@lucidpic.com. We support coordinated disclosure. We may geoblock, rate-limit, or disable CDN/object storage paths to mitigate abuse or comply with orders.
16. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms of Service
- Violation of our Acceptable Use Policy
- Non-payment of fees
- At the request of law enforcement or government agencies
- Extended periods of inactivity
- Fraudulent or illegal activity
Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service or contact us at hello@lucidpic.com.
We may suspend or terminate access, disable links, or remove content to comply with court or regulator orders, including business-disruption measures under the Online Safety Act 2023. We may geoblock specific regions or suspend API keys where required by law or order.
17. Disclaimers and Warranties
Service "As Is": The information on this site is provided on an "as is" basis. To the fullest extent permitted by law, Lucidpic:
- Makes no warranties or representations about the accuracy or completeness of content
- Does not warrant that the service will be uninterrupted, timely, secure, or error-free
- Does not warrant that results will meet your requirements
- Does not warrant against viruses or harmful components
AI-Generated Content: You acknowledge that:
- AI outputs may be inaccurate, biased, or inappropriate
- Outputs may resemble real persons or brands. You are solely responsible for verifying rights and lawful use
- Similar outputs may be generated for other users
- We are not responsible for your use of generated content
18. Limitation of Liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
- Our total liability shall not exceed the amount you paid us in the past twelve months
- These limitations apply regardless of legal theory and even if we knew of the possibility of damage
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. For consumers, we don't exclude or limit rights or remedies that cannot be excluded under UK law (including Consumer Rights Act 2015). Where a term conflicts with mandatory consumer rights, the consumer right prevails. For consumers, nothing here limits remedies required by the Consumer Rights Act 2015 for digital content.
19. Indemnification
You agree to defend, indemnify, and hold harmless Lucid Technology Labs and its licensees, licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) arising from:
- Your use of and access to the service
- Your violation of any term of these Terms of Service
- Your violation of any third-party right, including any copyright, property, or privacy right
- Any claim that your content caused damage to a third party
20. Content Reporting and Complaints Procedures
How to Report: Use the Account → Report Content flow or email hello@lucidpic.com with asset URL, timestamp, and reason.
No General Monitoring: We are not under a general obligation to monitor user content, but we act expeditiously to remove or disable access to unlawful content once we obtain actual knowledge, consistent with the Electronic Commerce (EC Directive) Regulations 2002. We run targeted automated checks (including IWF hash-matching) and act on lawful notices. We cooperate with the Internet Watch Foundation (IWF) and law enforcement on suspected child sexual abuse material (CSAM).
Complaints Procedure: If you disagree with an action we have taken regarding your content or a report you have made, you have the right to make a complaint:

- Include relevant details and supporting information
- We will review your complaint and inform you of our decision
- This process is separate from general customer support
21. Export Controls and Sanctions
You represent you are not a sanctioned person or located in a sanctioned country and will not use the Service for prohibited end uses. You shall comply with UK export control and applicable sanctions laws.
22. Dispute Resolution
Informal Resolution: We prefer to resolve disputes informally. Before filing a claim, please contact us at hello@lucidpic.com to attempt resolution.
Governing Law: These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Jurisdiction: Any legal action or proceeding shall be brought exclusively in the courts of England and Wales, except that consumers may rely on mandatory local consumer protection laws.
23. General Provisions
Entire Agreement: These Terms constitute the entire agreement between us regarding our service and supersede any prior agreements.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights to any of our affiliates or successors.
Notices: We may provide notices to you via email or through the service. You agree that electronic notices have the same legal effect as written notices.
Force Majeure: Neither party is liable for delays or failure caused by events beyond reasonable control.
Survival: Sections 6, 10-13, 17-23 survive termination.
Order of Precedence: If these Terms conflict with an Order Form or Data Processing Agreement, the Order Form/DPA controls for that conflict.

25. Updates to Terms
We reserve the right to modify these terms at any time. If we make material changes, we will notify you by email or by posting a notice on our site prior to the change becoming effective. Your continued use of the service after any changes constitutes your acceptance of the new Terms of Service.
